Terms of use

§ 1 Scope of application

(1) These user regulations apply to the RheinMain University and State Library (HLB RheinMain - "Library") of the Hochschule RheinMain University of Applied Sciences.

(2) The legal character of the user relationship is public law. Agreements under private law can be made on special uses.

§ 2 Tasks of the library

(1) The HLB RheinMain is the academic universal library of the RheinMain University and State Library for the city and region of Wiesbaden. It is used for studies, teaching and research as well as for academic appointments and general education. As a state library, it is an archive library for literature on Hessian history and regional studies. It has deposit copy rights for the city of Wiesbaden as well as for the districts of Hochtaunus, Lahn-Dill, Limburg-Weilburg, Main-Kinzig, Main-Taunus and Rheingau-Taunus.

(2) The library generally offers the following services:
a) Use of its holdings (including digital media) and its facilities on the library premises
b) Loan of media for use outside the library (local loan, inter-library loan, direct delivery)
c) Procurement of media that are not available locally through German or international inter-library loan, as well as outside inter-library loan
d) Providing oral and written information, providing information through catalogs, bibliographies, documentation services, electronic databases, subject portals
e) Teaching information literacy through training and guided tours
f) Exhibitions and events

§ 3 Admission for use

(1) The reading room and open access areas are accessible without formal admission. The user regulations are recognized by using the library. The user regulations are on display in the library.

(2) In principle, any natural person aged 14 or over who lives, works or studies in the Federal Republic of Germany for a period of at least three months is admitted to borrow media.

(3) In addition, other persons may be admitted for use if this does not impair the primary tasks of the library.

(4) Formal admission to use the library must be made in person. Written registration is only possible in justified exceptional cases. A valid identity card or alternatively a valid passport must be presented together with a German registration confirmation, whereby the current residential address must also be stated. Upon registration, the user must undertake to comply with the user regulations.

(5) Minors must submit a written declaration of consent from their legal representative upon registration. The latter undertakes to pay compensation for any damage and to pay fees and expenses.

(6) By providing an e-mail address, access is granted in accordance with the HVwVfG for the transmission of electronic documents. (see also § 18 of these user regulations)

(7) HLB RheinMain must be informed immediately of any change of name, address or e-mail address (if provided). The same applies to the disenrollment of students of Hochschule RheinMain. The user shall be liable for any costs incurred by HLB RheinMain as a result of failure to comply with this notification obligation.

(8) Admission may be subject to conditions.

(9) Admission for use may be limited in time.

(10) Admission for use may be denied if the person has already been excluded from use at another library.

(11) The user receives a library card. For students of Hochschule RheinMain, the StudentCard - after activation by the library - takes over the function of the library card. The library card entitles the user to borrow books and other media, provided this is not restricted (see § 12) and is required for every borrowing process. It also entitles the holder to use the PC workstations in accordance with the regulations issued for this purpose.

(12) The ID card is not transferable and remains the property of Hochschule RheinMain. Users are obliged to keep the ID card in a safe place and to report any loss or loss of the ID card immediately. A fee is charged for the reissue of an ID card or for deregistration in the event of a lost ID card in accordance with the applicable administrative cost regulations for the Ministry of Science and the Arts.

§ 4 Data processing and data protection

(1) Upon admission to use the library, users are informed about the storage and processing of their personal data.

(2) The library processes the following personal data of users after they have given their consent:
1) Family name,
2) Given name(s),
3) Date of birth
4) Home address (if different, address of legal representative)
5) Student identification number
6) Borrowing data for students of RheinMain University of Applied Sciences

(3) The data according to para. 2, items 1-6 can be transmitted to the library by the Hochschule RheinMain at which the users are enrolled.

(4) Personal data is subject to the provisions on data protection. They will be deleted as soon as the admission to borrowing expires and all usage processes have been completed.

§ 5 End or exclusion from use

(1) Anyone who violates these user regulations or whose behavior makes the continuation of a user relationship unreasonable can be temporarily or permanently excluded from use. After exclusion, all obligations arising from these user regulations shall continue to apply. The user must return all borrowed media as well as the library card and pay any outstanding fees and expenses.

(2) Paragraph 1 sentence 2, 2nd HS and sentence 3 shall also apply in the event that the requirements for admission to use are no longer met for other reasons, or the user relationship is properly terminated.

(3) The user relationship ends automatically if no media have been borrowed within three years.

§ 6 Office hours

The office hours are announced on notice boards and in other suitable forms. The library may be closed temporarily if this is necessary for operational reasons.

§ 7 Costs and service charges

(1) The use of the library, in particular the borrowing of books and other media, is generally free of charge.

(2) Other costs (fees and expenses) are charged on the basis of the Hessian Administrative Costs Act (HVwKostG) in conjunction with the General Administrative Costs Regulations (AllgVwKostO) and the Administrative Costs Regulations for the Ministry of Science and the Arts (VwKostO-MWK), as amended.

(3) For other services not covered by paragraphs 1 and 2, individual service fees may be agreed or set by the library.

(4) The enforcement of due fees and expenses shall be carried out in accordance with the provisions of the Hessian Administrative Enforcement Act in the currently valid version

§ 8 General obligations of users

(1) Every user is obliged to observe not only the user regulations, but also the general principles of order and to behave in a manner consistent with the character of the library as an academic workplace. The instructions of the library staff shall apply.

(2) The library management or persons authorized by it shall exercise domiciliary rights on behalf of the President of Hochschule RheinMain.

(3) Users and visitors are liable for any damage caused to the library as a result of non-compliance with these obligations.

(4) Library property and all furnishings must be treated with care and protected from any damage. In the event of loss or damage to media and other library property, full compensation must be paid. Damage also includes writing on, marking and underlining. The library determines the type and amount of compensation. In addition, a handling fee will be charged.

§ 9 Behavior in the library rooms

(1) In all rooms of the library used for research purposes, in particular in the reading rooms, open access areas and catalog rooms, quiet behavior must be avoided and consideration must be shown for other users. The reading room of the State Library may not be entered with overclothing, umbrellas, bags and the like. Eating and drinking is only permitted in the rooms designated for this purpose. It is not permitted to bring in or consume alcohol or to smoke. Animals are not permitted.

(2) Photographs, films and sound recordings may only be made in the library rooms with the consent of the library management.

(3) Posters and the display of information brochures etc. may only be admitted in consultation with the library.

(4) The library assumes no liability for the use of the storage facilities offered by the library for compulsory use (checkroom, lockers, etc.). The storage facilities are only available during the library's office hours. They must be vacated on the same day. Lockers that are still locked after the end of office hours can be opened. Any deposit will be forfeited. Locker users are liable to the library for any damage to the library resulting from the loss of a key. Otherwise, their use is subject to separate regulations by the library management.

(5) Items found in the library or removed from lockers that have not been cleared in due time will be kept for two weeks and then disposed of by the library.

(6) Reading and workstations may not be pre-occupied. Occupied but unused spaces may be vacated and reassigned by the members of staff of the library.

(7) When leaving the reading room and the open access areas, users must vacate their workstations. They must present all media and other materials to the exit control without being asked.

(8) The library may restrict the use of data processing devices to specific workstations. Wireless telephones may only be used as silent data carriers; the use of phones and entertainment devices is prohibited.

(9) The library is not liable for damage caused by the use of media and programs to the user's files, data carriers and hardware.

(10) The library is not liable for lost, damaged or stolen items belonging to the user in the library rooms.

§ 10 Use of media in the library rooms

(1) All media freely accessible and displayed in the library rooms may be used on site.

(2) As a rule, the library's reference collections and valuable books as well as books older than 100 years can only be used in the reading areas. In addition, the library may restrict individual works and parts of its holdings to use in the reading areas (cf. § 13 para. 2 a to i).

§ 11 Use of the IT workstations

The use of IT workstations is subject to separate regulations.

§ Section 12 Use of particularly valuable holdings and deposits

(1) The use of particularly valuable holdings (manuscripts, estates, autographs, incunabula, etc.) is generally restricted to academic purposes. In principle, they may only be used in the reading room of the State Library.

(2) In the case of deposits that have been handed over to the library by third parties for safekeeping, use may be restricted or even excluded for a certain period of time in accordance with the agreements with the owners.

(3) By signing an undertaking, the user of manuscripts, estates, autographs (also in the form of reproductions) undertakes:a) to observe the relevant copyright and personal rights provisions,b) to apply for permission from the library for reproductions,c) to provide the library with a free copy of reproductions and publications from and about these holdings.

(4) The use of particularly valuable holdings may be made subject to special conditions or may be refused in part or in full for reasons of conservation, copyright or personal rights or for other reasons.

(5) The use of particularly valuable collections from external libraries and the costs incurred are governed by the provisions of the Interlibrary Loan Regulations.

§ 13 General lending regulations

(1) The media available in the library can be borrowed for use outside the library.

(2) The following are generally excluded - mostly for reasons of inventory protection (cf. § 10):
a) Reference collections,
b) Rare books (manuscripts, autographs, estates, incunabula, etc.), c) Works older than 100 years, d) Nassovica published before 1946, ),
c) Works older than 100 years,
d) Nassovica published before 1946
e) Plates, atlases, maps,
f) Unbound works, loose-leaf collections, individual issues of unbound periodicals, newspapers,
g) Microforms,
h) Large-format works,
i) Media subject to special license conditions.

(3) In the case of works whose unrestricted use is not possible, lending may be made dependent on proof of academic or professional purpose or authorization.

(4) Media from the textbook collection are lent exclusively to members of Hochschule RheinMain.

§ 14 Lending on site

(1) The borrower is the person on whose card the items are borrowed. The library is entitled, but not obliged, to hand over the media to any person who presents the relevant library card and an authorization authorizing them to collect the media.

(2) When borrowing books or other materials, the user must immediately report any missing items or visible damage. Users may not repair damage themselves.

(3) The library may limit the number of simultaneous loans for individual users.

(4) Borrowed media may not be passed on by the user.

(5) Loaned media may be reserved for loan. The library may limit the number of reservations.

§ 15 Interlibrary loan

(1) Media that are not available in the library or in another local library can be borrowed from other German libraries in accordance with the Regulations on Interlibrary Loan in the Federal Republic of Germany (LVO). Check-out periods and other restrictions on use (e.g. "for the reading room only") are governed by the regulations of the lending library. In all other respects, the lending regulations apply.

(2) Media that are not available in German libraries but are indispensable for academic work can be ordered through international interlibrary loan.

(3) Costs charged by the foreign library are to be borne by the user for whom the media are ordered.

(4) Otherwise, required media can also be ordered from another library outside the interlibrary loan system by means of direct delivery. The lending conditions are based on the specifications of the lending library.(5) If media are made available to a user as a reproduction or for lending by direct delivery to another library, the user is liable for shipping costs and damages. In all other respects, the provisions of these user regulations apply.

§ 16 Check-out period

(1) The check-out period is generally four weeks. The library may set different check-out periods for certain items (e.g. journals). For official purposes, media may be reclaimed before the check-out period has expired.

(2) An extension of the check-out period is generally possible. Exceptions are reserved media. When extending the loan period, the library may request that the media in question be presented; it may also limit the number of extensions per unit. The extended check-out period begins with the date of the approved extension, not with the complete expiry of the original check-out period.

(3) If the loan period is not extended by presenting the library card on site, the user bears the burden of proof that the loan period has been extended and the risk of paying overdue fines if a loan period extension is not granted.

(4) The library may allow short-term loans of reference collections.

(5) For professors and members of staff of Hochschule RheinMain, the check-out period may be up to three months for official purposes. It can be extended three times by 3 months if no reservation has been made. After the 3rd extension, the borrowed media must be returned. Media that are still required can be borrowed again if there are no reservations.

(6) For professors of Hochschule RheinMain, a reference library can be set up on application.

§ 17 Exceeding the check-out period

(1) If the check-out period is exceeded, overdue fines will be charged in accordance with the Hessian Administrative Costs Act for the Ministry of Science and the Arts (VwKostO-MWK) as amended.

(2) The overdue fine is due when the overdue notice is issued. It always relates to each individual item borrowed.

(3) Before the return of reminded media and the payment of the costs, a new loan or renewal can be refused (loan block).

(4) After three unsuccessful overdue notices, enforcement proceedings will be initiated at the user's expense in accordance with the Hessian Administrative Enforcement Act (Hessisches Verwaltungsvollstreckungsgesetz - HessVwVG).

§ 18 Notification by email

If the user has provided the library with an e-mail address, this is available for sending information, notifications and any overdue notices subject to a charge, including the media data. The user agrees to the usual, unprotected method of sending emails.

§ 19 Disclosure and information

(1) The library provides oral and written information within the scope of its possibilities and on the basis of the information sources and holdings available to it.

(2) No guarantee is given for the correctness, completeness and accuracy of the information provided.

(3) The appraisal of media and manuscripts is not part of the library's tasks.

§ 20 Technical devices

(1) The library provides devices for the use of its media as far as possible.

(2) Users must ensure that the equipment is in good working order before using it. They shall inform the library staff immediately of any defects. The user is liable for any damage that is not due to normal wear and tear.

(3) The use of own technical devices in the library rooms requires the library's consent.

(4) The use of personal data carriers is only permitted on devices provided for this purpose and is at the user's own risk. The user is liable for any damage caused to the library's own equipment and files.

§ 21 Reproductions

(1) For personal and other personal use, copies and scans can be made in self-service on the premises within the scope of the technical conditions. It is possible to print out and store data at designated PC workstations.

(2) Within the scope of its possibilities, the library produces reproductions from its own and other libraries' collections against reimbursement of costs.

(3) If the library is unable to produce reproductions itself, it will commission a private company to do so in agreement with the user. The costs shall be borne in full by the user.

(4) The library may exclude individual media and certain parts of its holdings from reproduction for reasons of preservation.

(5) Reproductions from manuscripts, autographs and other valuable holdings may only be made with the library's permission and must always be commissioned from the library. The library may oblige the user to pass on reproductions of their manuscripts and autographs to third parties only with the library's permission.

(6) The user is responsible for ensuring that existing copyright or personal rights regulations and other rights of third parties are observed when reproducing from books and other materials.

§ Section 22 Scope of application

(1) No use within the meaning of these terms of use is:
a) lending for the purpose of exhibitions,
b) the production and publication of photographic images and other reproductions for commercial purposes.

(2) In cases which are not subject to the user regulations or for which fees are not set according to the administrative cost regulations, a special agreement can be made at the discretion of the library.

§ Section 23 Entry into force

These user regulations come into force on March 18, 2013. At the same time, the user regulations of the Hessian State Library Wiesbaden dated 22.12.2005 and the library of the RheinMain University and State Library dated 22.06.2009 will become invalid.
